Terms of Service
These Terms of Service ("Terms") govern your use of the Finisit platform, websites, mobile applications, and services (collectively, the "Platform"), operated by Finisit (Thailand). By accessing or using the Platform, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or accessing the Platform, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them.
2. Finisit Membership & Affiliate Program
Finisit operates a tiered membership and affiliate program. Membership tiers (Wave, Dolphin, Shark, Apex) are determined by business volume and active subscriptions. Commission structures are as described on the Platform and may be updated with notice.
- Commissions are earned on confirmed and settled transactions only.
- Fraudulent referrals will result in immediate account suspension and forfeiture of earnings.
- Payouts are processed monthly, subject to minimum thresholds.
4. Refund Policy
Physical merchandise (Finisit shop) purchases are eligible for a refund within 14 days of purchase, provided the order has not yet been fulfilled by our print partner. Refunds for fulfilled orders are subject to print-on-demand provider policy. Digital goods (course access, subscriptions) are non-refundable once delivered, except where required by applicable consumer protection law.
To request a refund, sign in and visit your dashboard → Orders within the eligible window, or email support@finisit.app with your order ID.
5. Promo Codes
Promotional codes are limited-time offers issued at our discretion. Each code may have its own restrictions (minimum order value, single-use per customer, expiry date, total redemption cap). Codes cannot be combined unless explicitly stated and have no cash value.
6. Prohibited Activities
- Creating multiple accounts to abuse referral programs
- Using bots or automated tools to manipulate metrics
- Misrepresenting Finisit products or earning potential
- Any activity that violates applicable laws or regulations
7. Limitation of Liability
To the maximum extent permitted by law, Finisit shall not be liable for any indirect, incidental, or consequential damages arising from use of the Platform.
8. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance. Material changes will be notified via email or Platform announcement.
9. Regulatory Status
Finisit is not registered with the U.S. Securities and Exchange Commission (SEC), the Commodity Futures Trading Commission (CFTC), the Office of the Securities and Exchange Commission, Thailand (ก.ล.ต.), the Bank of Thailand, or any other financial regulator. Nothing on the Platform constitutes financial, investment, legal, or tax advice. Trading and investing involve significant risk of loss. Past performance is not indicative of future results. Consult a licensed financial advisor before making any investment decision.
10. Governing Law & Jurisdiction
These Terms are governed by, and construed in accordance with, the laws of the Kingdom of Thailand, without regard to its conflict-of-law principles. Any dispute, controversy, or claim arising out of or relating to these Terms — including questions of formation, interpretation, breach, or termination — shall be submitted to the exclusive jurisdiction of the courts of Bangkok, Thailand.
Where you reside in a jurisdiction whose mandatory consumer-protection law gives you stronger rights (e.g. EU under the Consumer Rights Directive), those rights are unaffected by this clause.
11. Dispute Resolution
Before commencing any formal proceeding, you agree to attempt to resolve disputes informally by contacting legal@finisit.app with a written description of the issue. If we cannot reach a resolution within 30 days, either party may pursue formal legal remedies in the courts identified in §10.
13. Severability & Entire Agreement
If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Finisit regarding the Platform.
